Birmingham Bar Association CommitteesGeneralFee Arbitration Fee Arbitration Committee The Fee Arbitration Committee is available at no cost to arbitrate matters involving disputes between attorneys and clients regarding attorney fees. Either the attorney or the client may refer the dispute to this arbitration forum however, both parties must agree in writing to arbitrate the dispute and also agree that the decision of the Fee Arbitration Committee will be binding. The decision of the Fee Arbitration Committee is confidential and the dispute will be heard by no fewer than three committee members. To initiate a fee arbitration a Request For Fee Arbitration form should be submitted to Beth Carmichael, Executive Director of the Birmingham Bar Association. She will ascertain whether the parties involved are agreeable to binding arbitration by the Committee and she will obtain signed statements to that effect. If both parties agree to arbitrate their fee dispute, a date and time will be set for the hearing.
